Pixel Plugins provides subscription-based software services, digital products, and custom development services. By accessing, purchasing, subscribing to, or using any of our services, you agree to these Terms and Conditions.
1. Services
- We provide digital software solutions, including plugins, licensed tools, integrations, and custom-built development services.
- No physical products are sold unless explicitly stated otherwise.
- Some services may be offered on a subscription basis, while others may be provided as one-time or milestone-based custom projects.
2. Licenses and Usage
- Each license or subscription is valid only for the specific account, platform instance, project, or deployment for which it was purchased.
- Licenses and subscriptions are non-transferable unless we approve otherwise in writing.
- You may not copy, resell, redistribute, reverse engineer, or misuse our software, code, or services except where permitted by law or by written agreement.
3. Subscription Billing and Renewal
- Subscription fees are billed in advance on a recurring basis unless otherwise stated.
- Subscriptions renew automatically unless canceled before the next billing date.
- If a free trial is offered, it may automatically convert into a paid subscription unless canceled before the trial period ends.
- You are responsible for managing your subscription and cancellation through the relevant platform or billing method, including platforms such as Buildfire or Shopify where applicable.
4. Payments
- All fees are due as stated at the time of purchase or in an applicable proposal, invoice, or custom agreement.
- For custom development services, deposits, milestone payments, and completed work are non-refundable unless otherwise agreed in writing.
- Late or failed payments may result in suspension of access, delayed delivery, or termination of services.
5. Refunds
Refunds are governed by our Return & Refund Policy. Unless otherwise stated in writing, all payments are generally non-refundable, especially for digital services, subscriptions, and work already performed.
6. Custom Development Services
- Custom projects are delivered based on the agreed scope, requirements, timeline, and pricing communicated between both parties.
- Any changes or additions outside the agreed scope may require additional time, fees, or a revised agreement.
- You are responsible for providing accurate requirements, timely feedback, required access, and any materials necessary for delivery.
- Delays caused by missing information, late feedback, or third-party dependencies may affect delivery timelines.
7. Intellectual Property
- All pre-existing tools, software, frameworks, plugin code, methods, and materials developed or owned by Pixel Plugins remain our property unless expressly agreed otherwise in writing.
- For custom development, ownership of final deliverables may be defined separately in a project agreement or invoice terms.
- Unless otherwise agreed in writing, we retain ownership of our underlying tools, reusable components, know-how, and proprietary code.
8. Third-Party Platforms and Services
- Some of our services depend on third-party platforms, APIs, hosting providers, payment processors, or marketplaces, including but not limited to Buildfire, Shopify, Stripe, and similar services.
- We are not responsible for outages, policy changes, API limitations, account restrictions, billing issues, or functionality changes caused by third-party providers.
- Your use of those third-party services may also be subject to their own terms and policies.
9. Support and Maintenance
- Support is provided through email or another designated support channel.
- We aim to address technical issues within a reasonable timeframe, with priority given to critical issues.
- Support does not include customizations, feature additions, or work outside the original scope unless otherwise agreed.
10. Acceptable Use
- You agree not to use our services for unlawful, abusive, fraudulent, or harmful purposes.
- You may not use our services in a way that damages, disables, overburdens, or interferes with our systems, software, or reputation.
11. Disclaimer of Warranties
Our services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we do not guarantee uninterrupted, error-free, or fully compatible operation in all environments or third-party platforms.
12. Limitation of Liability
To the fullest extent permitted by law, Pixel Plugins shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, business opportunities, or goodwill arising from the use of or inability to use our services. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim during the 3 months preceding the event.
13. Suspension and Termination
- We may suspend or terminate access to our services if you violate these terms, fail to pay fees, abuse support, initiate improper chargebacks, or use the services unlawfully.
- You may stop using our services at any time, but termination or cancellation does not automatically entitle you to a refund.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. Continued use of our services after updated terms are posted means you accept the revised terms.
